Our family department handles a wide variety of privately funded family matters including:

  • Divorce – Under the Matrimonial Causes Act 1973, there is one ground for divorce: the irretrievable breakdown of a marriage. Before a divorce can be granted by a court, it has to be shown that a marriage has broken down by giving evidence in writing of any one of the following five facts:

    1. The adultery of the other spouse
    2. The unreasonable behaviour of the other spouse
    3. Two years’ desertion
    4. The couple has lived apart for two years and the other spouse consents to divorce
    5. The couple have lived apart for five years (no consent needed)
  • Ancillary relief – a financial order which may deal with the sale or transfer of property, maintenance payments, a lump sum payment and/or a pension sharing or attachment order.
  • Contact problems involving children
