Our family department handles a wide variety of privately funded family matters including:
- Divorce – Under the Matrimonial Causes Act 1973, there is one ground for divorce: the irretrievable breakdown of a marriage. Before a divorce can be granted by a court, it has to be shown that a marriage has broken down by giving evidence in writing of any one of the following five facts:
- The adultery of the other spouse
- The unreasonable behaviour of the other spouse
- Two years’ desertion
- The couple has lived apart for two years and the other spouse consents to divorce
- The couple have lived apart for five years (no consent needed)
- Ancillary relief – a financial order which may deal with the sale or transfer of property, maintenance payments, a lump sum payment and/or a pension sharing or attachment order.
